Farmer Black did not repair his fence following last month's breach and his cows took advantage of his failure again!

His fence or your joint boundary fence?
It's our boundary fence and my trees have never breached it. His cattle beasts dictate the need for effective fencing and his responsibility, I'd have thought, is measured against that. I've kept the fence in such condition that my trees have never burst through and damaged his farm.
Rg, you might be half responsible for the boundary fence but you are totally responsible for your forest, and its protection.
In a 'past' life I had quite few neighbours and at times had to return their stock. guess what I did.......
i mended the fence.
You farmers! Surely the keeper of the livestock is responsible for keeping those livestock on their property. The fence is sufficient to keep cows out, but not steers. Of course I'm responsible for the state of my garden, so can take actions to protect it; writing stories about it for the NZGardener, letters to the editor of the local rag etc. to encourage the farmer to fulfill his legal responsibilities. To add to the problem, those steers, once through that permeable fence, can wander down onto the main highway and if someone crashed into them and was killed, I'm betting "Farmer Black" would be answering the charge, not me. Legal responsibility is the salient point, I reckon. And there's always the temptation to herd those steers into my freezer...
...."and there's always the temptation......" now there IS a thought Rg!
After all the old adage is "Possession is nine tenths!!"
Farmer Black is welcome to any of my fruit that falls over the fence and onto his farm :-)
